Welcome to SiteScanX. By accessing or using our website accessibility scanning service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and SiteScanX ("we," "us," or "our").

Eligibility

To use our Service, you must:

SiteScanX provides website accessibility scanning and analysis services, including:

• Detailed accessibility reports and recommendations
• Scheduled scanning capabilities
• API access for integration (on applicable plans)
• Historical scan data and analytics

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

Subscription Plans and Payments

Free Plan

Our free plan provides limited access to the Service. We may modify or discontinue the free plan at any time.

Paid Plans

For paid subscriptions:

• Billing: You will be billed in advance on a recurring basis (monthly or annually)
• Payment Methods: We accept major credit cards and other payment methods as displayed
• Auto-Renewal: Subscriptions automatically renew unless cancelled before the renewal date
• Price Changes: We may change subscription prices with 30 days' notice
• Refunds: Refunds are provided on a case-by-case basis at our discretion
• Taxes: You are responsible for all applicable taxes

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period. No refunds will be provided for partial billing periods.

Acceptable Use Policy

You agree NOT to:

• Scan websites you do not own or have permission to scan
• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the Service or servers
• Use automated scripts or bots to abuse the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Resell or redistribute the Service without authorization
• Remove or alter any proprietary notices or labels
• Upload malicious code, viruses, or harmful content
• Violate any applicable laws or regulations

Violation of this policy may result in immediate termination of your account and legal action.

Intellectual Property Rights

Our Rights

The Service, including all content, features, functionality, software, and design, is owned by SiteScanX and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Your Content

You retain ownership of any URLs, websites, or content you submit for scanning. By using the Service, you grant us a limited license to access, scan, and analyze the submitted content solely for the purpose of providing the Service.

Feedback

Any feedback, suggestions, or ideas you provide about the Service become our property, and we may use them without restriction or compensation.

Disclaimers and Limitations of Liability

Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Accuracy of Scans

While we strive for accuracy, our automated scans may not detect all accessibility issues. We do not guarantee that our Service will identify every WCAG violation or that following our recommendations will ensure full compliance. You are responsible for verifying compliance with applicable accessibility standards.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SITESCANX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless SiteScanX, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any intellectual property or other rights.

Termination
